  (Cushing, Okla.) — A Stroud teenager, who allegedly told an officer that he was high on methamphetamine and fentanyl, has been jailed on $7,500 bail on charges of attempting to elude Cushing police from the 1100 block of E. Walnut to Highway 99 at speeds of over 120 mph, as well as stealing two gas cans and a chainsaw.
    At his arraignment Tuesday in Payne County District Court, Devin Dean Brown, 19, was given an application for a court-appointed attorney.
    If convicted of attempting to elude Cushing police, Brown could be given a prison term of one to five years plus a fine of $1,000 to $5,000. If convicted of two counts of petty larceny, Brown could be given a one-year jail term plus a $1,000 fine.
    Brown was arrested at 4:47 am on June 29 at Highway 99 just south of E. Texaco Road by Cushing Police Officer David Smith — 13 minutes after officers were sent to the 1200 block of E. Maple Street on a report of a suspicious vehicle, an affidavit said.
    During an ensuing chase, Brown ran a stop sign at E. Walnut Street and N. Highland Avenue, endangered the life of a motorist as he passed at a high rate of speed in a construction zone on E. Main Street, and endangered several motorists as he ran a stop sign at Harmony and 9th Street, the affidavit alleged.
    “At one point in an attempt to catch up to the vehicle, I was going more than 126 mph. The suspect did not maintain his lane and was driving in the opposite lane of traffic,” Officer Smith alleged in his affidavit.
    After the suspect was arrested, “I asked Devin why he ran. Devin advised because he did not have a driver’s license and because it was not his car. Devin advised he did not know who owned the car but got the car from a buddy in Bristow.
    “I asked Devin what he was doing in Cushing; he advised he was just driving around when he started running out of gas, so he was trying to find some gas cans so he could fill up the gas cans in order to bring the car back to him. I asked Devin if he was trying to siphon gas; he advised he was. I asked Devin if he had siphoned any gas; he advised no. Davin just found the two gas cans.
    “I asked Devin if he stole the gas cans. He advised he did. Devin advised he stole one gas can from one residence and stole the other gas can from the other residence. Devin advised me he had taken the chainsaw and one of the gas cans out of the back of a pickup on Walnut Street,” the officer alleged in his affidavit.
    “As I was almost finished booking in Brown, Brown advised he was high on methamphetamine and fentanyl. Brown advised he was still feeling the effect of the drugs currently. I asked Brown when he had used the meth and fentanyl and he advised about 45 minutes prior to us pursuing him,” the officer alleged in his affidavit.
    “I then transported Brown to the Hillcrest Hospital in Cushing for a blood draw,” to be sent to the state crime bureau for chemical analysis, the officer wrote in his affidavit.
    At about 6:46 am, Brown was transported back to the Cushing City Jail after he was medically cleared, the affidavit said.
