STILLWATER — A Stillwater man, who allegedly admitted to selling cocaine, has been jailed on $100,000 bond pending a May 5 court appearance at which he can seek a preliminary hearing on a charge of trafficking about 28 grams of the drug.
Lance Dean Magby, who was also charged with having a firearm during the commission of a felony and also drug paraphernalia, could be incarcerated for as long as 31 years and fined $111,000 if convicted of all three counts.
Magby was arrested on Feb. 26 after Stillwater Police Detective Josh Carson received anonymous information that cocaine was being distributed at Magby’s residence, an affidavit alleged.
During a traffic stop for not wearing a seat belt while driving his truck, Magby became increasingly nervous when a K9 alerted to the odor of illegal drugs, the affidavit alleged.
After detectives searching Magby’s truck found two baggies, one new and the other with a white powdery residue that appeared to be cocaine, “Magby spontaneously uttered that sometimes he partakes,” the affidavit alleged.
When Magby’s residence, where he lived with a relative, was searched on a warrant, “In the gun safe located on the west wall of Magby’s room, I found digital scales, numerous 2×2 baggies that were new, a Tupperware container of cocaine, and a .45 automatic pistol. It was clear Magby was selling cocaine,” Detective Carson alleged in his affidavit.
After his arrest, “Magby told me he sells cocaine to his friends to make extra money because he does not have a job. Magby stated he has been selling for approximately four years on and off. Magby told me he is selling approximately one ounce of cocaine every week to two weeks,” the detective alleged in his affidavit.
