(Stillwater, Okla.)  — Former Oklahoma State University wrestler Albert James Ferrari Jr. has been ordered to appear in court this afternoon for arraignment on a criminal charge accusing him of sexually battering a family friend in her Stillwater apartment.
Ferrari, 21, of Stillwater, was arrested last week and released on $25,000 bail on the felony charge, which carries a maximum penalty of 10 years in prison on conviction, court records show.
A woman reported to Stillwater police on July 2 “that she had been sexually assaulted by Albert James “AJ” Ferrari Jr. during the previous early morning hours,” Stillwater Police Detective John Paul Johnson wrote in an affidavit.
She said that at about 10:30 pm on July 1, she and two friends “went to two bars on the Strip,” where she had about four drinks, the affidavit alleged. She said her friends went to another friend’s house, so she left the bars and met them there at about 1:30 or 1:45 am, the affidavit alleged.
She said that about 30 minutes after she arrived at the house, “Ferrari sent her a Snapchat message and asked what she was doing,” the affidavit alleged. She said, “She told him that she was at a friend’s house, and he asked if he could come over,” the affidavit alleged.
She said that she knew the Ferrari family and was invited to Ferrari family outings, as well as to hang out at the Ferrari family home, the affidavit alleged.
She said, “she has only hung out with Ferrari as a friend and while with his family, and never in a romantic way,” the affidavit alleged.
She said when she decided it was time for her to go home, she asked Ferrari if he would take her home, the affidavit alleged. She said, “she didn’t think this wasn’t anything out of the ordinary because she was friends with Ferrari’s family, and she didn’t want to walk back to her apartment given the hour,” which was about 3 am, the affidavit alleged.
She said that “when they got to a stoplight, she told Ferrari that he could just drop her off by the apartment entrance. He said no that he was going to park and then proceeded to park in the parking garage. She told him that she could take herself up to her apartment, but he said he wanted to make sure she was safe,” the affidavit alleged.
She said, “they were laughing and joking on the way up to her apartment,” where they went straight to the combination kitchen-living room area, the affidavit alleged.
“During this time, Ferrari started taking drinks from a bottle of tequila that had been left out on the kitchen counter. Soon (she) told Ferrari that she was tired. He said he was tired too, but he claimed he was drunk and asked to stay the night,” the affidavit alleged.
She said that “Ferrari didn’t act drunk, but since Ferrari said he had to leave by 7 and that was just about three hours away, (she) told him he could sleep on the couch and started walking toward her bedroom. But instead of going to the couch, Ferrari passed (her) in the hallway and went to her bedroom where he started taking off all his clothes except his underwear,” the affidavit alleged.
She said, “she grabbed a tee shirt and shorts and went to her private bathroom where she changed clothes. When she got out of the bathroom, Ferrari had already laid down in her bed,” the affidavit alleged.
She said, “she laid down in the bed and put a pillow between them in an attempt to ensure nothing would happen. (She) said Ferrari then started saying how he was jealous of (her) ex-boyfriend and how the ex-boyfriend got to be with (her). She told Ferrari that she didn’t see Ferrari as a romantic partner,” the affidavit alleged.
She said that he then grabbed her and began sexually battering her, the affidavit alleged. She said that she “was trying to fight him off while Ferrari kept trying to kiss her and commenting on how she was putting up a good fight,” the affidavit alleged.
After Ferrari performed various sexual acts, she said he grabbed a towel from her bathroom and wiped her off, the affidavit alleged.
Saying that she did not consent to any of the acts, she told the detective that “she was scared, traumatized and didn’t know what to do. (She) said Ferrari got back in bed and told her that he liked how she put up a good fight,” the affidavit alleged.
