(Stillwater, Okla.) — A Cushing man accused of choking his girlfriend, pushing a glass table top at her leg and punching her in the face when he knew she was pregnant has been released from the Payne County Jail on $5,000 bail with an order to have no contact with her.
If convicted of domestic assault and battery by strangulation, Dexter Dantinell Toles, 23, could be incarcerated for one to three years and fined $3,000. If convicted of domestic assault and battery against a pregnant woman, Toles could be given as much as a one-year jail term. Toles has been ordered to appear in court on May 14 with an attorney.
Cushing Police Officer Gavis Thomas was sent at 8:39 p.m. on April 6 to talk to a woman who said that Toles had assaulted her, according to his affidavit.
The woman said that she is nine weeks’ pregnant with Toles’ child, the affidavit said.
She said “she and Toles had been arguing so she asked him to leave,” the affidavit said.
She said “Toles became angry and threw the glass top to their coffee table at her — striking her leg,” the affidavit alleged.
She said when she grabbed her phone to call her mother to come over and convince Toles to leave, “Toles took her phone from her — not allowing her to call her mom,” the affidavit alleged.
She said Toles put both of his hands around her neck — “applying enough pressure for her to have difficulty breathing,” the affidavit alleged.
She said she was able to bite Toles — getting him to let go, the affidavit alleged.
She said Toles then punched her with a closed fist approximately three or four times, the affidavit alleged.
She said “she was struck in the head and stomach,” the affidavit alleged.
She alleged that Toles had been abusive in the past, but a check of court records indicated that he had not been charged in Oklahoma.
She had slight swelling next to her left eye, scratches on both wrists and under her chin, and discoloration on her stomach that appeared to be the start of a bruise, the affidavit said.
