(Stillwater, Okla.) — A 25-year-old Cushing man accused of punching a male relative in the face was arraigned Tuesday on a charge of aggravated assault and battery, court records show.
The defendant, Justin Phoenix Henderson, remains free on $5,000 bail pending a Feb. 5 court appearance at which he can seek a preliminary hearing on the felony, which carries a maximum penalty of a five-year prison term on conviction.
The victim, who reported the incident several weeks after the alleged attack in November of 2023, said that his jaw had been fractured by Henderson, Cushing Police Officer Kyle Wright alleged in an affidavit.
Henderson said that the victim “shoved him first, and that’s when he hit him,” the affidavit alleged.
The victim told the Cushing officer that Henderson “also threatened to really hurt me if I pressed charges against him,” the affidavit alleged.
