
(Stillwater, Okla.) – A former convict at the Cimarron Correctional Facility pleaded guilty Friday to stabbing an inmate at the private prison in Cushing, in a case investigated by the Oklahoma Department of Corrections.
Eduardo Leiva, 36, who has been transferred to the Oklahoma State Penitentiary in McAlester, told a Payne County judge in court Friday that he used a piece of wire in the stabbing on Oct. 5, 2017, at the Cushing prison.
As part of a plea bargain approved by District Judge Phillip Corley, Leiva was given an additional five-year prison term Friday in the case that was reduced by the prosecution from assault and battery with intent to kill to assault and battery with a dangerous weapon.
“Eduardo Leiva was identified by CCF Chief of Security Larry Cox after the assault via a review of security video footage,” that showed Leiva pursuing the victim with an improvised weapon in his right hand as he attacked him, an affidavit by a DOC agent said.
The victim, who was transferred to another prison in Oklahoma, had 21 stab wounds for which he was treated at the Cushing hospital, the affidavit said.
Leiva’s sentence for the stabbing was ordered Friday to run after he completes 10 concurrent 30-year prison terms and one concurrent 35-year prison terms for 11 counts of armed robbery in Oklahoma County in 2009, court records show.
