(Stillwater, Okla.) — Authorities are searching for a repeat drug offender from Tulsa charged in Payne County with committing child sexual abuse when he lived in Stillwater last year.
An arrest warrant was issued a month ago from Payne County for Dustin Leroy Drake, 38, who could receive as much as a life prison term if convicted of making an 11-year-old girl look at and touch his penis at his then-home in Stillwater.
The girl’s mother contacted police last summer to report her daughter said that Drake had sexually assaulted her in his home in Stillwater, an affidavit alleged.
Stillwater Police Investigator Shawn Millermon alleged in an affidavit, “On Sept. 3, 2020, I was present for a forensic interview conducted at the Child Advocacy Center in Stillwater where (the girl) disclosed she was sexually assaulted one time in Stillwater by Dustin and multiple times at his home in Tulsa.”
The girl “did not know the address of Dustin’s home in Stillwater, but was able to describe it,” the affidavit said.
Through the investigation, the officer determined the house was in the 1600 block of E. Elm Avenue in Stillwater, the affidavit alleged.
The girl said that she, her younger sister and her mother “went to Dustin’s house for a movie night,” the affidavit alleged.
She said, “she and her sister were upstairs watching the movie with Dustin,” while her mother was downstairs, the affidavit alleged.
“During the movie, (the girl), Dustin and her sister were lying on the bed with (the girl) in the middle,” the affidavit alleged.
The girl “stated that Dustin was asking her questions by typing them on his phone and then showing,” her, the affidavit alleged.
The girl “stated Dustin would then erase the text and type again. The messages were never sent,” the affidavit alleged.
When he asked her if she had ever seen a penis and she typed back no, she said “Dustin then grabbed her hand and placed her hand on his penis,” on top of his clothing, the affidavit alleged.
After he asked her younger sister to go downstairs and retrieve a white board to play a game, she said “when her sister left the room, Dustin pulled his pants down showing the tip of his penis,” to her, the affidavit alleged.
The girl said “Dustin then had her touch his penis with her hands,” the affidavit alleged.
She said “she could hear her sister coming because she stomps when she walks. (She) stated Dustin stopped when she could hear her sister,” the affidavit alleged.
She said that when her sister came into the room, “they began playing a game on the whiteboard,” the affidavit alleged.
She said she “did not initially report the assault because she was afraid (her mother) would hate Dustin,” the affidavit alleged.
When the investigator interviewed her mother, “she advised Dustin wished to meet her somewhere to talk,” the affidavit alleged.
According to the girl’s mother, “Dustin told her the reason for the meeting was to get something off of his chest,” but the meeting never happened and he got a new phone number, the affidavit alleged.
The investigator said he attempted to contact the man at the number the girl’s mother provided, but when he heard the phone pick up, nobody answered, the affidavit said.
“I attempted to speak to whoever answered the phone, but nobody responded. I called the number back. It rang a few times and then went to voice mail. I left a voice message for Dustin to call me back. I have not received a response from Dustin,” the investigator wrote in his affidavit that was filed with the charge last month.
Drake had been released from prison to two years of probation in September of 2019 after serving seven months of three concurrent two-year sentences for possession of marijuana with intent to distribute after the 2017 Tulsa County charge was reduced from drug trafficking, as well as having no tax stamp and acquiring proceeds from drug activity, court records show.
At the same time, Drake served seven months of two concurrent two-year prison terms for possession of marijuana with intent to distribute in 2013 and use of video surveillance in the commission of a felony in Tulsa County, for which he was originally given in 2014 probation that was revoked in 2019, court records show.
